FAVOR’D XOXO TERMS OF SERVICE

Welcome to Favor’d XOXO. These Terms of Service (“Terms”) govern your use of our website and your purchase of products and services from Favor’d XOXO.

By accessing our website, submitting an order, purchasing a product, or requesting customization, you acknowledge that you have read, understood, and agreed to these Terms.

Please review these Terms carefully before placing an order.

1. GENERAL TERMS

Favor’d XOXO provides customized party favors, event accessories, personalized products, party bundles, and related merchandise.

Because many of our products are customized specifically for each customer and event, customers are responsible for reviewing all policies, customization information, turnaround times, and order details before purchasing.

Favor’d XOXO reserves the right to update products, pricing, policies, processing times, availability, and these Terms at any time.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving suspected fraud, abusive behavior, prohibited customization requests, pricing errors, product or supply unavailability, or circumstances preventing us from legally or reasonably completing the order.

2. FULL PAYMENT REQUIRED

All Favor’d XOXO orders require 100% payment upfront.

We do not accept deposits, partial payments, payment plans, or agreements to pay the remaining balance after production begins unless Favor’d XOXO expressly provides a written exception.

Your order is not confirmed and does not enter our production queue until full payment has been successfully received.

Favor’d XOXO will not purchase supplies, begin customization, reserve production time, or begin production for an unpaid order.

Submitting an inquiry, requesting a quote, discussing a design, sending customization information, or providing an event date does not reserve your order or production date.

Your order is officially secured only after full payment is received.

NO PAYMENT = NO CONFIRMED ORDER = NO PRODUCTION.

Prices, inventory, and production availability are not guaranteed until payment is received. If pricing, inventory, or availability changes before payment is submitted, the customer may be required to accept an updated quote or product option.

3. CUSTOM & PERSONALIZED ORDERS

Many Favor’d XOXO products are customized, personalized, handmade, or made-to-order.

Customers are responsible for providing complete and accurate customization information.

This may include:

Names, dates, phrases, photographs, logos, social media handles, event details, colors, themes, quantities, wording, sizes, and any other information necessary to complete the order.

Favor’d XOXO is not responsible for mistakes contained in information submitted by the customer.

Customers should carefully review all spelling, dates, names, quantities, colors, and customization instructions before submitting them.

4. WHEN TURNAROUND TIME BEGINS

Your turnaround time does not begin simply because you contacted Favor’d XOXO or requested an order.

Turnaround time begins once:

1. Full payment has been received; and

2. All required customization information, photos, names, themes, colors, sizes, wording, quantities, and other requested materials have been submitted.

If a proof or design approval is required, production may not begin until the design has been approved.

Delays caused by missing customer information, late responses, design changes, or delayed approvals may result in a later completion date.

5. DESIGN & CREATIVE DISCRETION

Unless a specific final design has been expressly agreed upon, customers authorize Favor’d XOXO to use reasonable creative discretion when creating customized products based on the theme, colors, inspiration, and information provided.

Fonts, placement, sizing, decorative elements, image positioning, and other minor design details may vary.

Inspiration or reference photos are used for creative guidance only.

Favor’d XOXO does not guarantee an exact reproduction of another business’s, creator’s, or designer’s work.

6. DESIGN PROOFS & APPROVALS

When Favor’d XOXO provides a digital proof, customers are responsible for reviewing the entire design carefully before approving it.

Approval confirms that you accept the:

Spelling, names, dates, wording, colors, images, layout, placement, design, and other visible details.

Once a design has been approved and production has begun, changes are not guaranteed.

Changes requested after approval may require an additional design, material, or remake fee and may extend the turnaround time.

Favor’d XOXO is not responsible for customer-approved errors.

7. NO REFUNDS — ALL SALES FINAL

ALL SALES ARE FINAL.

Because Favor’d XOXO products may be customized, personalized, handmade, made-to-order, or require supplies purchased specifically for your order, we generally do not offer refunds, returns, or exchanges after an order has entered production or supplies have been purchased.

Changing your mind, changing your event theme, canceling your event, ordering the incorrect quantity, submitting incorrect customization information, or no longer needing the products does not automatically qualify an order for a refund.

This policy does not limit any rights or remedies that cannot legally be waived under applicable consumer protection laws.

If Favor’d XOXO makes a material error in fulfilling your order, contact us promptly so we can review the issue and determine the appropriate resolution.

8. CANCELLATIONS

Cancellation requests are not guaranteed.

Because Favor’d XOXO may purchase materials and begin design or production shortly after receiving an order, an order may become non-cancellable once supplies have been purchased, customization has begun, or production has started.

If an order has not yet entered production or required any order-specific expenses, Favor’d XOXO may determine whether a cancellation can be accommodated.

Any legally required refund rights remain unaffected.

9. PRICING

Prices are subject to change without notice.

Custom order pricing may depend on:

Quantity, product type, materials, customization complexity, design requirements, requested turnaround time, and other order-specific factors.

A quote does not reserve inventory, pricing, or production availability.

Pricing and production availability are secured only when the order has been fully paid.

Additional products or customization requested after checkout may require a separate purchase.

10. TURNAROUND TIMES

Turnaround times are estimates unless Favor’d XOXO expressly agrees in writing to a guaranteed completion date.

Turnaround time begins only after full payment and all required customization information have been received.

Rush orders may be available depending on our current production schedule and may require an additional rush fee.

Customers are responsible for placing orders early enough to allow sufficient time for production and delivery or pickup.

11. EVENT DATES

Customers must provide accurate event dates when requested.

Providing an event date does not automatically guarantee completion by that date unless Favor’d XOXO has expressly confirmed that deadline.

Customers are responsible for ordering sufficiently in advance.

Favor’d XOXO is not responsible for missed events resulting from customer delays, incorrect information, late approvals, shipping carrier delays, incorrect shipping addresses, or circumstances reasonably outside our control.

12. SHIPPING

Shipping and delivery estimates are estimates unless expressly guaranteed.

Once an order has been transferred to the shipping carrier, carrier delays may be outside Favor’d XOXO’s control.

Customers are responsible for providing a complete and accurate shipping address.

Favor’d XOXO is not responsible for delays or failed deliveries caused by incorrect or incomplete addresses submitted by customers.

If a package is returned because of an incorrect address or delivery issue attributable to the customer, the customer may be responsible for additional shipping charges before the package can be shipped again.

Please contact Favor’d XOXO promptly if your package arrives materially damaged.

13. LOCAL PICKUP

When local pickup is available, customers must follow the pickup instructions provided by Favor’d XOXO.

Customers should pick up orders within the agreed pickup timeframe.

Once an order has been completed, failure to pick it up does not automatically qualify the customer for a refund.

Customers should inspect their order promptly after receiving it and report any material fulfillment issue as soon as reasonably possible.

14. HANDMADE & CUSTOM PRODUCT VARIATIONS

Many Favor’d XOXO products are handmade or individually customized.

Minor differences in printing, placement, cutting, sizing, color, materials, positioning, or overall appearance may occur.

These minor variations are part of the customization process and do not necessarily constitute defects.

Colors may also appear differently in person because of lighting, photography, screen settings, printing methods, and materials.

15. PRODUCT CARE

Customers are responsible for following any care, cleaning, storage, or use instructions provided with their products.

Unless expressly advertised otherwise, customers should not assume that customized products are dishwasher-safe, microwave-safe, waterproof, weatherproof, or designed for repeated washing.

Favor’d XOXO is not responsible for damage caused by improper washing, excessive moisture, heat, improper storage, misuse, or failure to follow provided care instructions.

16. CUSTOMER-PROVIDED PHOTOS, LOGOS & DESIGNS

By providing Favor’d XOXO with photographs, logos, graphics, names, trademarks, phrases, artwork, or other materials for customization, you represent that you have the necessary permission or legal right to use those materials for the requested purpose.

You authorize Favor’d XOXO to reproduce the submitted materials as reasonably necessary to design, manufacture, and fulfill your order.

Favor’d XOXO reserves the right to refuse customization requests that we reasonably believe may violate intellectual property rights, applicable laws, or our policies.

17. PHOTOS & PORTFOLIO USE

Favor’d XOXO may photograph or record completed products for use in our portfolio, website, social media accounts, advertisements, promotional content, and other business marketing.

We will not intentionally publish private customer information beyond information already incorporated into the customized product.

If an order contains personal information that you do not want publicly displayed, please notify Favor’d XOXO before production or photography whenever possible.

18. PRODUCT AVAILABILITY & SUBSTITUTIONS

Certain products, materials, colors, packaging, accessories, or supplies may become unavailable.

If an item necessary for your order becomes unavailable, Favor’d XOXO may contact you regarding a reasonably comparable alternative.

We will generally seek customer approval before making a substitution that materially changes the appearance or nature of the order.

19. CUSTOMER CHANGES AFTER ORDERING

Customers should submit final customization information when placing their order.

Changes requested after payment are not guaranteed.

If Favor’d XOXO has already designed, printed, cut, customized, assembled, or purchased materials based on the original information, additional fees may apply to make requested changes.

Significant changes may also extend the original turnaround time.

20. RUSH ORDERS

Rush availability is determined by Favor’d XOXO based on our current production schedule.

Rush orders may require an additional fee.

Paying a rush fee does not eliminate the customer’s responsibility to provide all customization information and approvals promptly.

Customer delays may affect the completion of a rush order.

21. INTELLECTUAL PROPERTY

Favor’d XOXO branding, original graphics, logos, website content, marketing materials, photographs, templates, product designs, and other original creative materials remain the intellectual property of their respective owner unless otherwise stated.

Purchasing a customized product does not transfer ownership of Favor’d XOXO intellectual property.

Favor’d XOXO original designs may not be copied, reproduced, resold as digital designs, or used commercially without permission.

22. WEBSITE USE

You agree not to misuse the Favor’d XOXO website, attempt unauthorized access, interfere with website functionality, conduct fraudulent transactions, or unlawfully copy or distribute protected website content.

We make reasonable efforts to accurately display product information, images, and descriptions.

Because customized products are individually produced, the final product may contain reasonable variations from website examples.

23. PROMOTIONAL CODES & SPECIAL OFFERS

Promotional codes, discounts, bundles, and special offers are subject to their stated terms and availability.

Unless otherwise stated, promotional offers cannot be combined.

Favor’d XOXO reserves the right to correct promotional or pricing errors and reject fraudulent or unauthorized use of discount codes.

24. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Favor’d XOXO will not be responsible for indirect, incidental, special, or consequential damages arising from the purchase or use of our products.

To the fullest extent permitted by law, Favor’d XOXO’s aggregate liability relating to an individual order will not exceed the amount actually paid to Favor’d XOXO for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

25. FORCE MAJEURE

Favor’d XOXO is not responsible for delays or inability to perform caused by circumstances reasonably outside our control.

These circumstances may include severe weather, natural disasters, power outages, internet outages, carrier disruptions, supply shortages, governmental actions, emergencies, or similar events.

We will make reasonable efforts to communicate significant delays affecting active orders.

26. GOVERNING LAW

These Terms are governed by the laws applicable to Favor’d XOXO’s principal place of business, except where applicable consumer protection laws require otherwise.

27. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

28. POLICY ACCEPTANCE

By submitting payment and placing an order with Favor’d XOXO, you acknowledge that you have reviewed and agreed to:

• Our Customization Policy

• Any product-specific terms displayed at checkout or on the applicable product page

Failure to read these policies does not automatically exempt a customer from the terms agreed to when placing an order.
